1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of juliaclaireclay.com, our online store, products, content, communications, and related services (collectively, the “Services”). The Services are operated by Julia Claire Weber under the name Julia Claire Clay (“Julia Claire Clay,” “we,” “us,” or “our”).
By accessing the Services, placing an order, uploading a file, or enrolling in an email or SMS program, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least the age of majority where you live and able to enter into a binding contract to make a purchase. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Changes to the Services or Terms
We may update the Services and these Terms from time to time. The “Last updated” date identifies the most recent revision. Changes apply when posted unless a later date is stated. Your continued use after an update means you accept the revised Terms to the extent permitted by law.
4. Products and availability
We try to describe products, colors, dimensions, materials, prices, and availability accurately. Screen settings, photography, ceramic materials, glazes, firing conditions, and manufacturing tolerances can affect appearance and results. Product images are illustrative and may not show exact color or scale.
Products and quantities may be limited, changed, or discontinued. We may limit or refuse an order where reasonably necessary, including for suspected fraud, pricing or listing errors, unlawful content, technical limitations, or misuse of the Services. If we cancel a paid order, we will refund the canceled amount.
5. Orders, prices, and payment
An order is an offer to purchase. We may accept or reject it, and an automated confirmation does not necessarily mean acceptance. You agree to provide current, complete, and accurate purchase, billing, contact, and shipping information.
Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping, customs duties, and other charges may be added where applicable. International customers are responsible for import charges assessed by their country. Payment and checkout are processed through Shopify and its payment providers and may be subject to their terms.
6. Custom artwork and decal orders
Your rights and permissions
You retain ownership of artwork you submit. By submitting artwork, you grant Julia Claire Clay a limited, non-exclusive, worldwide license to receive, store, reproduce, resize, color-process, proof, print, and otherwise use the artwork only as reasonably necessary to review, fulfill, support, remake, or document your order and comply with law.
You represent and warrant that you own the artwork or have all rights, licenses, releases, and permissions needed for us to reproduce it, and that our fulfillment of your instructions will not violate copyright, trademark, privacy, publicity, contract, or other rights.
Content we may refuse
We may decline or cancel work that we reasonably believe is unlawful, infringing, fraudulent, threatening, hateful, exploitative, sexually abusive, invasive of privacy, or otherwise likely to create legal or safety risk. A refusal does not mean we have reviewed or approved all rights in any artwork we accept.
File preparation and approval
You are responsible for the accuracy, spelling, dimensions, resolution, color profile, and content of submitted files. We may flag an apparent quality issue as a courtesy, but we are not responsible for finding every error. If you approve a proof or ask us to proceed after a warning, the approved file controls.
Digital screens use RGB light while ceramic decals use mineral-based CMYK materials. Exact screen matching is not possible. We strongly recommend a test sheet and test firing before a large production run.
Application and firing
Ceramic results depend on the substrate, glaze chemistry, application, kiln calibration, firing schedule, ventilation, and other conditions outside our control. Follow the instructions supplied with the product and use appropriate ceramic-studio safety practices. Unless caused by a printing defect covered by our Returns & Reprints Policy, we do not guarantee firing results.
7. Shipping, risk of loss, returns, and reprints
Processing and delivery estimates are not guarantees. Delays may occur because of file approval, carrier operations, customs, weather, supply issues, or events outside our control. Title and risk of loss transfer as provided by applicable law and the shipping terms presented at checkout.
Custom-printed decal products generally cannot be returned when correctly produced. Printing defects, incorrect items, and qualifying transit damage may be eligible for a reprint. Full details, deadlines, and exclusions are in our Returns & Reprints Policy. Processing times, destinations, carriers, and international charges are described in our Shipping Information. Those policies are incorporated into these Terms.
8. Promotions and discount codes
Promotions may be subject to additional terms shown with the offer. Unless stated otherwise, an offer is limited to one use per customer, has no cash value, cannot be combined with another offer, and may be modified or ended where permitted by law. A discount applies only to eligible products and does not apply to taxes, shipping, prior purchases, or gift cards unless expressly stated.
We may reject a discount obtained through error, fraud, duplication, unauthorized publication, or use inconsistent with its stated terms. If popup creative advertises a discount, the offer details shown in that popup and at checkout control.
9. Acceptable use
You may not:
- use the Services for an unlawful, fraudulent, infringing, or abusive purpose;
- upload malware or code intended to disrupt, damage, monitor, or gain unauthorized access;
- interfere with security, rate limits, checkout, or another person’s use of the Services;
- scrape, harvest, or collect data through automated means without written permission;
- impersonate another person or misrepresent an affiliation;
- attempt to reverse engineer or circumvent access controls; or
- use site content to train or build a competing commercial model or dataset without permission.
We may suspend or terminate access for conduct that violates these Terms or creates risk for the Services, customers, or others.
10. Intellectual property
Except for customer-submitted artwork and third-party materials, the Services—including site design, text, photographs, illustrations, graphics, logos, videos, downloads, educational materials, and other content—are owned by or licensed to Julia Claire Clay and protected by intellectual-property laws.
We grant you a limited, revocable, non-transferable license to use the Services for personal or internal business shopping and informational purposes. No other rights are granted. You may not reproduce, sell, distribute, modify, publish, or commercially exploit site content without prior written permission or a right provided by law.
11. Feedback and submissions
If you voluntarily submit feedback, suggestions, reviews, or non-confidential ideas, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and publish them for operating, improving, and promoting the Services. This does not apply to private custom artwork submitted solely for order fulfillment.
12. Email terms
By subscribing to marketing email, you agree to receive promotional email from Julia Claire Clay. You can unsubscribe at any time using the link in a marketing email or by contacting us. Opting out of marketing does not prevent transactional or service messages related to your order, inquiry, security, or an ongoing relationship.
Offers sent by email may have additional eligibility, expiration, product, or combination restrictions stated in the message.
13. SMS/MMS mobile messaging terms
This section applies if Julia Claire Clay offers a text-message program and you enroll. By providing your mobile number and affirmatively opting in, you authorize Julia Claire Clay and service providers acting on its behalf to send recurring automated promotional and personalized marketing SMS or MMS messages to the number you provided. Messages may be sent using an automatic telephone dialing system or other automated technology. Consent is not a condition of any purchase.

We may send one final non-promotional text confirming an opt-out. We will also honor other reasonable methods that clearly communicate a request to stop, as required by law. After opting out, you may need to opt in again before receiving marketing texts.
You represent that you are the subscriber or customary user of the number provided and are authorized to consent. If your number changes, is reassigned, or is deactivated, you agree to opt out or notify us promptly. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed. The program may not be available on every carrier or device.
We may change, suspend, or end the SMS program. If these SMS terms materially change, we will provide notice as required. Mobile information is handled as described in our Privacy Policy.
14. Third-party services and links
The Services may use or link to third-party platforms, including Shopify, payment services, carriers, social networks, analytics tools, and hosting providers. We do not control third-party services and are not responsible for their content, availability, terms, or practices. Your use of them may be governed by separate terms.
15. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” JULIA CLAIRE CLAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, completely secure, or compatible with every device, material, glaze, kiln, or intended use. Educational content is general information and is not a substitute for professional safety, legal, tax, or technical advice specific to your circumstances.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JULIA CLAIRE CLAY AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, ARTWORK, BUSINESS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM A PRODUCT, ORDER, OR THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR $100.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Julia Claire Clay and its service providers from claims, damages, liabilities, losses, and reasonable costs arising out of your submitted artwork, your violation of another person’s rights, your unlawful misuse of the Services, or your material breach of these Terms.
18. Governing law and disputes
These Terms are governed by applicable United States law and the law of the U.S. state in which Julia Claire Clay has its principal place of business, without regard to conflict-of-law rules. Courts with jurisdiction over that principal place of business will have jurisdiction over disputes, except where applicable consumer law gives you the right to bring a claim elsewhere.
Before filing a formal claim, please contact us and describe the dispute so we can try to resolve it informally. Nothing in this section prevents either party from seeking relief in small-claims court where eligible or requesting urgent relief to protect intellectual-property or security rights.
19. General terms
If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer or by operation of law.
